摘要(Abstract)：

2015年,国家明确了深化电力体制改革的重点和路径,并把完善市场化交易机制作为重点任务之一,电力交易合同作为依法开展交易的重要形式,对于电力市场规范运作有着举足轻重的影响。长期以来,电力交易合同以纸质合同形式签订,较难适应灵活交易的要求,应用电子签名来签订合同可以较为方便地解决上述问题,但电子数据具有易消失性和易篡改性,不象纸质合同那样单独具有法律效力。结合电力交易合同的现状和发展要求,对在电力交易中应用电子签名的可行性进行了探讨,认为在电力交易中应用电子合同不存在法律禁区,但要构建管理机制和运用技术手段,以确保电力交易合同的法律效力。
In 2015, the nation clarifies the key points and paths to electric power system reform deepening,and it takes the perfection of marketing trade mechanism as one of the key tasks. As a key mode of lawful trade, electric power trading contracts are decisive to the normal operation of electric power market. Electric power trading contracts for a long time are signed on paper, which can hardly adapt to the trading flexibility while electronic signature used for contract signing can easily solve the above-mentioned problem. However,the electronic data, not having the same force of law with paper contracts, may get lost and juggled easily.The paper, in view of status quo and development requirement of electric power trading contracts, discusses the application feasibility of electronic signature in electric power trading and believes that there is no law-forbidden zone in electronic contract application in electric power trading. However, administrative mechanism shall be established and technical measures shall be taken to guarantee the force of law in electric power trading contracts.
